1) Introduction

Vortex Media LLC, Inc. and/or its affiliates (collectively, “Vortex,” “we,” “us,” or “our”) provides technology and services to digital publishers and other business customers (collectively, “Publishers”). These services may include Vortex’s curated marketplace, ad-serving and monetization tools, video and/or display advertising products, and publisher-facing components such as a video player or similar integrations (collectively, the “Services”).

Publishers use the Services on their websites, apps, connected TV environments, or other digital properties (the “Properties”) to deliver content and serve advertising.

This Privacy Policy describes Vortex’s privacy practices regarding information that may be collected about individuals who visit or use Properties that embed or interact with our Services (“End Users,” “you,” or “your”).

2) What Information We Collect

We collect information in connection with the Services in the categories described below. The specific data collected depends on how a Publisher implements the Services, the device you use, and applicable permissions/choices.

A. Personal Information

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with you or your device.

Device and app information may include:

  • Device type/model, operating system, system language, carrier (if available)
  • Browser type and version, app identifier (where applicable)
  • IP address
  • Device identifiers used for advertising and measurement (e.g., mobile advertising identifiers such as IDFA/AAID, or other device/SDK identifiers)

B. Non-Personal / Aggregated / Technical Information

We may also collect information that is not identifiable on its own, such as technical, diagnostic, and aggregated usage data (“Non-Personal Information”). This can include:

  • Browser/OS type, screen resolution, language settings
  • Approximate network-derived location (e.g., city/country)
  • Log data (timestamps, referrers, error logs, performance diagnostics)
  • Interaction and usage data related to ads and content (e.g., ad impressions, clicks, viewability signals, frequency counts)

Important: If Non-Personal Information is combined with Personal Information (or otherwise becomes linkable to an identifiable device/user), we treat it as Personal Information to the extent required by applicable law. 

3) Advertising and Ad Interaction Data

Because the Services support ad delivery and measurement, we may collect and process:

Ad information, including:

  • Ads served (or attempted), ad placement and context, and the number of times an ad is served
  • Whether you viewed, clicked, or otherwise interacted with an ad
  • Ad engagement history and related measurement signals (e.g., conversions such as visiting an advertiser’s site or completing an action, where supported by the integration)

4) Location Information

We may infer coarse location (such as city/country) using IP address or similar network signals. This generally does not reveal precise location.

In some environments, precise location may be collected by third parties (e.g., advertisers or measurement partners) only if you enable device-level location services and the applicable app/site provides that access consistent with permissions and law.

5) How We Use the Collected Information

We use the information we collect for purposes such as:

  • Serving ads and content (including contextual and interest-based advertising where permitted)
  • Ad measurement, reporting, and conversions (e.g., impression/click reporting, attribution)
  • Frequency capping (limiting repeated exposure to the same ad)
  • Analytics and research (understanding usage, improving performance, benchmarking in aggregated form)
  • Fraud detection and prevention (invalid traffic, suspicious activity, brand safety, security)
  • Providing, maintaining, and improving the Services (debugging, QA, new features)
  • Enforcing policies and compliance (terms enforcement, dispute resolution, legal obligations)

We do not “rent” or “sell” Personal Information in the traditional sense. Where laws define “sale,” “sharing,” or similar concepts broadly (e.g., for cross-context behavioral advertising), Vortex provides choices described in Section 10 (Your Choices & Opt-Outs).

6) With Whom We Share Information

We may share information collected via the Services with:

  1. Publishers whose Properties you access, to provide reporting and enable monetization (e.g., ad delivery metrics, performance insights).
  2. Advertisers and their agencies (and measurement partners), when needed to provide campaign reporting, measurement, attribution, and fraud prevention.
  3. Service providers and subprocessors (e.g., hosting, cloud services, analytics, fraud prevention, reporting vendors) who process data on our behalf under contractual restrictions.
  4. Affiliates and related entities, where relevant to providing the Services.
  5. Legal and safety disclosures, when required by law, court order, or when necessary to protect rights, safety, or prevent fraud/security incidents.
  6. Business transfers, such as a merger, acquisition, financing, or sale of all or part of our business (subject to appropriate confidentiality protections).

We may also share aggregated or de-identified information that cannot reasonably be used to identify you, for analytics, reporting, or business purposes.

7) Legal Bases (Where Required)

Where required (e.g., in certain jurisdictions), Vortex processes Personal Information under one or more legal bases such as:

  • Consent (where required/implemented)
  • Legitimate interests (e.g., securing and improving Services, fraud prevention)
  • Contract necessity (to provide Services to Publishers)
  • Compliance with legal obligations

Publishers may also collect and control data independently; see Section 12 (Publishers as Controllers / Third Parties).

8) International Transfers

Vortex operates globally, and information may be processed in countries other than where you live. Where required, we use appropriate safeguards for cross-border transfers (such as contractual protections) and take steps designed to protect Personal Information consistent with applicable law.

9) Tracking Technologies

When you access Properties using the Services, Vortex and authorized third parties may use technologies such as cookies, pixels, SDKs, tags, scripts, and similar tools (“Tracking Technologies”) to:

  • Operate and enhance the Services
  • Deliver and measure ads
  • Perform analytics and troubleshooting
  • Apply frequency capping and fraud prevention

Publishers may implement consent tools and/or preference mechanisms (e.g., a consent banner) to help you manage these technologies.

10) Your Choices & Opt-Outs

Your choices may vary by device, browser, and jurisdiction.

A. Cookie/Browser Controls

Most browsers let you manage cookies and site data through settings. Blocking cookies may affect certain site functionality.

B. Industry Opt-Out Tools

You can learn more and opt out of certain interest-based advertising via industry tools such as:

  • DAA WebChoices (opt-out for participating companies)
  • NAI opt-out information/tools

C. Global Privacy Control (GPC)

If you enable a recognized opt-out preference signal such as Global Privacy Control (GPC), we (and/or Publishers) may treat it as a request to opt out of certain forms of “sale”/“sharing” or targeted advertising where required by law and supported by our implementations.

D. Mobile Advertising Identifiers

On mobile devices, you can typically limit ad tracking or reset your advertising identifier through device settings (e.g., iOS/Android advertising controls).

E. “Do Not Sell or Share” Requests (Where Applicable)

Where applicable law provides such rights, you (or an authorized agent) may request to opt out of “sale” or “sharing” of Personal Information (as defined by that law). See Section 11 for how to submit requests.

11) Your Privacy Rights

Depending on where you live, you may have rights such as:

  • Access to the Personal Information we hold about you
  • Deletion of certain Personal Information
  • Correction of Inaccurate Personal Information
  • Portability (receiving certain data in a structured format)
  • Restricting or objecting to certain processing
  • Opting out of targeted advertising/sale/sharing (where applicable)

We may need to verify your request (which can include confirming device identifiers or other signals), consistent with applicable law.

12) Publishers as Controllers / Third Parties

Publishers control their Properties and may collect information independently from Vortex. Advertisers, measurement providers, and other third parties may also collect information directly through their own technologies on a Property.

This Privacy Policy does not cover third-party privacy practices. We encourage you to review the applicable Publisher privacy policy and any relevant third-party policies.

13) Data Retention

We retain Personal Information only as long as reasonably necessary for the purposes described in this Policy, including providing the Services, complying with legal obligations, resolving disputes, enforcing agreements, and preventing fraud.

Retention periods may vary depending on data type, technical constraints, and contractual requirements with Publishers.

14) Security

We maintain administrative, technical, and physical safeguards designed to protect information processed through the Services. However, no security measure is perfect, and we cannot guarantee absolute security.

15) Children / Minors

The Services are not directed to children under 16 (or the age of legal consent for data processing in the relevant jurisdiction, if higher). If we learn we have collected Personal Information from a minor in a manner not permitted by law, we will take appropriate steps to delete it.

16) Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Last Revised” date indicates when it was most recently updated. If changes are material, we will provide notice through the Services and/or other appropriate means.
